Terms of Use

These terms govern your use of Ridepilot (“Ridepilot”, “we”, “us”, or “our”), our website and our services. By using Ridepilot you agree to these terms. If you do not agree, do not use the service.

1. The service

Ridepilot is a safety, compliance and asset-management platform for amusement-industry operators. Features, content and availability may change at any time.

You are responsible for your account, the accuracy of information you provide and for any activity carried out under your credentials. Keep your password confidential and notify us promptly of any unauthorised access.

You retain ownership of content you submit to Ridepilot. You grant us a worldwide, non-exclusive licence to host, store, process and display that content solely to provide and improve the service. You warrant that you have the rights necessary to submit your content.

5. Our intellectual property

Ridepilot and all related materials, software, branding and content (other than your content) are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, revocable, non-transferable licence to use the service in accordance with these terms.

Some features of Ridepilot may be free; others require payment. Pricing is set out on our website or as agreed in writing. We may change fees with reasonable notice. Free trials are subject to any additional terms communicated at signup.

We aim to make Ridepilot available reliably but do not warrant that the service will be uninterrupted, error-free, or available at any particular time.

8. Disclaimers

To the maximum extent permitted by law, Ridepilot is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot be excluded by agreement.

9. Limitation of liability

To the maximum extent permitted by law:

Where the Australian Consumer Law applies and a consumer guarantee is breached, our liability is limited (at our option, where permitted) to re-supplying the service or refunding the fees paid for it.

You agree to indemnify us against claims, losses and expenses arising from your breach of these terms, your misuse of the service, or content you submit.

We may suspend or terminate your access at any time for any reason, including breach of these terms. You may stop using the service at any time. Provisions that by their nature should survive termination will survive.

We may update these terms from time to time. We will post the updated terms here with a new “Last updated” date. Continued use of the service after changes constitutes acceptance.

14. Governing law

These terms are governed by the laws of Australia. The exclusive jurisdiction for any dispute arising under these terms is the courts of Australia.
